Site Based Contracts Manager, Rotterdam – Netherlands We are seeking a Contracts Manager to join our team to support projects based at our Rotterdam Project Sites, The Netherlands. You’ll be reporting to the Project Contracts Manager. This position requires experience in:
  • Contract strategy, Contracts development and creating workable contracting plans for execution;
  • Market enquiries using pro-forma contract models for a wide range of site services Contracts and PO’s and thorough understanding of developing the bid packages including the contract terms and conditions and the development of the full contract model including supporting technical inputs, BOQ assessment with preambles and supporting technical and commercial evaluation requirements;
  • Understanding of Contracts and PO’s commercial models application (Unit rates, BOQ, reimbursable and Lump Sum) and the contract administration for managing and understanding of contract terms (including bespoke models) for contractual intent and application;
  • Site experience in managing contracts and contractors to meet the contract and project demands.  Team player to ensure cooperation, coordination and administration of contracting requirements through execution.
  • Negotiation and award of Contracts and PO’s, alignment on technical and commercial clarifications for final evaluation and recommendations for award, for execution of Contracts;
  • SAP registration, management for contracts and PO’s including invoice management and payment support. NDA’s will be required as per process.
  • Use of the online Scout Platform for bidding contracts and PO’s, carrying out Prequalification and approval of new suppliers/contractor, and supporting commercial/technical evaluation and award management.
  • Robust Change Management including oversight of site changes, site instructions, engineering changes and mitigation of contract cost and schedule impact/growth;
  • Proactive Claims management including building dossiers for communications, changes, delays, mitigations, counter claims etc; and
  • Reporting to ensure accurate forecasting of contract deliverables and be responsible for proactively managing their own workload.  
Key tasks and responsibilities – what you’ll be doing

  • Work with Project teams (engineering, construction, commissioning, project controls, commercial etc), supporting the Project to achieve goals primarily focused on Contracting Strategy, Proposals, Sourcing, Contracting Awards and Project Contract Execution for Engineering, Construction EPC Projects and various service This includes:
    • Proposal and estimating support for Projects including sourcing budget pricing from the market as a requirement for benchmarking market rates and resource availability;
    • Preparing and executing the Projects Contracts and PO’s Strategy identifying the life of project requirements including working with planning and cost/estimating to understand budget allocations against Contracts and PO’s;
    • Preparing and executing the sourcing plan identifying and qualifying suppliers including E/EP/EPC and professional Services companies, engineering & construction suppliers to meet requirements and understand safety, commercial, technical and capacity risks;
    • Drafting and preparation of bidding documents and the Pro-forma Contract incorporating the technical scope of work, pricing schedules for various commercial models including remeasure Contracts and PO’s, QA/QC and HSSE requirements, and contract execution requirements;
    • Leading bid packages including issue to the market, clarifications, technical and commercial evaluations, negotiation and placement of Contracts and PO’s;
    • Conducting Kick-Off meetings and commercial meetings with Contractors.
    • Timely preparation of contractual documents such as Letters of Instructions, Contract Change Orders / Modifications, Insurance Documents, Subcontractor Approval packages, Certificate of Final Acceptance, and other legal or contractual requirements as required;
    • Preparing and negotiating cost impacts and schedule for contract Change Orders / modifications / claims assessment / arbitration;
    • Performance management of Contracts and PO’s. Manage relationships and maintain interface for project execution with Contractors;.
    • Monitor, communicate, and respond to changing market conditions and business drivers to maximize leverage and minimize risk; and
    • Effectively participate in Continuous Improvement activities.

Requirements

Critical competencies  
  • Contract management and administration experience is critical for this role and understanding of end-to-end contracts from placement to close out.
  • Core skills in contract management, including experience in both lump sum and remeasure Contracts for construction.
  • Strengths in drafting Contracts and PO’s and legal understanding of contract risk and the key clauses for contract execution and successful delivery of projects
  • Integrates cost forecasting and planning for Contracts and PO’s management throughout the project lifecycle.
  • Good Knowledge of SAP and requisition to pay processes
  • Excellent negotiation and contract resolution skills.
  • Strong influencing, communication, and facilitative skills, including cross cultures and geographies,
  • Ability to achieve targets and goals with clarity on action planning
  • Ability to work cross functionally internally
  • Demonstrated ability to effectively communicate (written and verbal) technical and non-technical information, internally and externally.
  • Strong organizational and time management skills
  • Good analytical and problem-solving skills
  • Strong understanding of macro-economic factors
  • Financial and Business acumen to support forecast cost modelling, and contract commercial applications.
  • Desire to work in a fast-paced environment
  • Excellent knowledge and proficiency with the Microsoft office suite (Excel, Word, PowerPoint, One Note) and collaborative tools. 
What we’re looking for
  • 15 years + experience working in Industrial Gases or complex engineering / construction projects.
  • MRICS and or CIPS
  • Bachelor of Engineering (preferably Mechanical / Civil) or QS degree is advantageous.
  • Experience in Contracts and PO’s and contractual language.
  • Excellent oral and written English proficiency is a must.
